OFFICIAL RULES
Promotion Description:
The deugro group promotion at Break Bulk Middle East 2025 (“Promotion”) is administered by DEHOCO (Deutschland) GmbH (“deugro”). The Promotion will grant one lucky winner a Fitbit Charge 6. Between all participants who upload a picture playing pickle ball in deugro’s booth and tag @deugro on Social Media, a winner will be selected in a random drawing.
For the Promotion, “Social Media” includes [Instagram and LinkedIn].
Eligibility:
In order to be eligible for the Promotion you must be a registered attendee of Break Bulk Middle East 2025. deugro employees are not eligible for the Promotion.
Official Prize:
The winner of the Promotion will win a Fitbit Charge 6. No additional costs associated with or incurred by the winning of the raffle, including but not limited to taxes or administrative charges, will be borne by the promoter.
Winner Selection:
The Promotion will run on the evening of February 10th and another on the evening of February 11th 2025. Participants must upload a picture to Social Media playing pickle ball at deugro’s booth and tag @deugro by 11:59pm (GMT+4) to be considered in the Promotion for that day. There will be one winner chosen each night at random by a computer program and they will be notified via Social Media.
Verification of eligibility to participate in the Promotion will be determined by deugro, whose decisions are final and binding in all matters related to the Promotion. Participants must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. Each potential prize winner will be required to sign and return an Affidavit of Eligibility, Liability and Publicity Release (the “Affidavit”) (except where prohibited), which must be received by deugro within thirty (30) days of the date of notice of being selected as a winner, in order to claim their prize. If a potential winner of the prize cannot be contacted, fails to sign and return the Affidavit within the required time period (if applicable), or prize is returned as undeliverable, such potential winner forfeits the prize. In the event the prize winner is disqualified for any reason, deugro will award the prize to an alternate winner by random drawing among all remaining eligible participants.
Release:
By receipt of any prize, winner agrees to release and hold harmless deugro and its respective affiliate companies, as well as each such company’s officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt, use, or misuse of any prize.
Privacy:
Except where prohibited, participation in the Promotion constitutes winner’s consent to the deugro group data Privacy Policy and Terms linked to deugro’s website.
General Conditions:
deugro reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, or other factor beyond deugro’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by deugro in its sole discretion. In such event, deugro reserves the right to award the prize at random from among eligible entries received up to the time of the impairment.
Deugro reserves the right, in its sole discretion, to disqualify any individual, without compensation, it finds to be tampering with the entry process or the operation of the Promotion in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, deugro reserves the right to seek damages from any such person to the fullest extent permitted by law.deugro’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Limitation of Liability:
deugro as promoter, is not liable for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Promotion; (2) unauthorized human intervention in any part of the entry process of the Promotion; (3) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (4) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Promotion.
Disputes:
Except where prohibited, participant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved with the individual in their own personal capacity; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Promotion if any, but in no event attorney’s fees; and (3) participant waives all rights to claim, indirect, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and deugro in connection with the Promotion, shall be governed in accordance with the laws of the UAE. Any controversy arising under or in relation to this Agreement shall be settled by arbitration. The arbitration shall have its seat and be held in Dubai in the English language and shall be arbitrated under the rules of the International Chamber of Commerce (“ICC”) by an arbitrator appointed by the ICC. The decision of such arbitration shall be final and binding upon the parties, and the cost of the arbitration, including the fees and expenses of the arbitrator(s), will be shared equally by the parties, with each party paying its own attorney’s fees. As a formality and not for the purpose of judging the validity thereof, the arbitration decision and award may be submitted to a court with jurisdiction in the place where any party hereto may be found for the purpose of recognition and enforcement of the arbitration decision and award.
